Is the deposit refunded if the sale contract is cancelled?
The contract’s cancellation terms decide it; without a clause making the sale conditional on a satisfactory survey, the deposit usually stays with the seller.
Why it works this way
This is why the survey condition belongs in the contract from the outset. An independent, measurement-based report then gives both sides the common ground a dispute needs.
